Please read these Terms and Conditions ("Terms") carefully before using the services provided by Fortune365 ("we," "our," "us"). By accessing or using our services, you agree to be bound by these Terms.

1. Service Description
Fortune365 provides astrological analysis and related services, including but not limited to zodiac-based forecasts, personalized analysis, and subscription-based content. Our services are delivered through various platforms and are priced in USD unless otherwise specified.

2. Account Registration and Security
To access our services, you may need to create an account. You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. Subscription Services and Refund Policy

Our services include both subscription-based and one-time purchase products. By using our services, you acknowledge and agree to the following:

a) Payment and Billing
- All payments are processed through SamCart, with USD as the default currency.
- Subscription fees are charged at the beginning of each billing cycle via SamCart’s automated payment system. In case of payment failure, SamCart may attempt to reprocess the payment within a specified period, and you agree to comply with SamCart’s payment retry policies.
- One-time purchases are charged immediately via SamCart.


b) Refund Policy for Digital Products
- Unopened/unread reports: 7-day refund window from purchase date
- Opened/downloaded reports: Non-refundable
- Personalized astrological analyses: Final sale, non-refundable
- Subscription services: No partial refunds for current billing period

c) Refund Process
To request a refund:
1. Email refund request to admin@fortune365.biz
2. Include order number and proof of purchase
3. State reason for refund
4. Confirm report has not been opened/used

d) Automatic Renewal

Subscriptions automatically renew unless cancelled. You may cancel your subscription through the SamCart Customer Portal, your account settings, or by contacting us directly at admin@fortune365.biz.


e) Dispute Resolution Process

i. Refund Eligibility
- Digital products are eligible for refund within 7 days of purchase if unused
- Personalized products and accessed content are non-refundable
- Subscription services cannot be partially refunded

ii. Dispute Submission

- All disputes must first be submitted through our support system
- Payment disputes processed through SamCart will be addressed using SamCart’s transaction records and our access logs
- We reserve the right to decline refunds for violations of these Terms

iii. Resolution Timeline
- Initial response within 7 business days
- Comprehensive resolution within 14 business days
- All decisions are final after the review process


iv. Evidence Requirements
To process a dispute, you must provide:
- Proof of purchase
- Confirmation of non-access to content
- Any relevant communication history


f) Regional Specific Refund Rights

European Union (EU) Customers:
- EU customers benefit from a 14-day statutory right of withdrawal period for digital services and products as per the EU Consumer Rights Directive 2011/83/EU.
- This withdrawal period begins from the day of purchase contract conclusion.
- To exercise this right, customers must notify us of their decision to withdraw before the 14-day period expires.
- However, by accessing or downloading our digital content, you acknowledge that you lose your right of withdrawal as per Article 16 of the EU Consumer Rights Directive.

United Kingdom (UK) Customers:
- UK customers benefit from a 14-day statutory right to cancel for digital services and products under the Consumer Contracts Regulations 2013.
- Similar to EU regulations, this right is forfeited once digital content has been accessed or downloaded with your prior express consent.

Other Jurisdictions:
- Customers from other regions may have statutory rights that cannot be excluded or limited by our Terms.
- Where local consumer protection laws provide stronger protections than our standard policy, those local laws will prevail.
- We will honor all mandatory consumer protection regulations applicable in your jurisdiction.


4. User Obligations
When using our services, you agree to:
- Provide accurate information
- Maintain the security of your account
- Use the services in accordance with applicable laws
- Respect the rights of others

You agree not to:
- Misuse our services
- Attempt to gain unauthorized access
- Interfere with service operation
- Engage in any unlawful activities

5. Intellectual Property
All content provided through our services, including but not limited to text, graphics, logos, and analyses, is our property or licensed to us. This content is protected by copyright and other intellectual property laws.

6. Service Limitations
While we strive to provide reliable services, we cannot guarantee:
- Continuous, uninterrupted access
- Error-free operation
- Specific results or outcomes
- Email delivery timing

7. Disclaimer of Warranties
Our services are provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not warrant that the services will be uninterrupted, timely, secure, or error-free.

8. Limitation of Liability
To the maximum extent permitted by law, Fortune365 shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.

9. Termination
We reserve the right to terminate or suspend your access to our services at our sole discretion, without notice, for any reason, including but not limited to a breach of these Terms.

10. Changes to Terms
- We may modify these Terms at any time. Material changes will be communicated via email or a prominent notice on our website.
- Your continued use of our services following such modifications constitutes acceptance of the updated Terms.

11. Governing Law
These Terms are governed by the laws of Hong Kong SAR. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Hong Kong SAR.
